1. Acceptance of Terms

By accessing or using 3DGhar ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, agents, builders, photographers, and contributors of content.

2. Account Registration

2.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

2.2 Account Types

The Service offers different account types (Buyer, Agent, Builder, Photographer, Owner). Each account type has specific features, responsibilities, and terms. You must comply with the terms applicable to your account type.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

3. User Responsibilities

You are responsible for:

  • All content you post, upload, or share on the Service
  • Ensuring you have the right to post content and grant us the license to use it
  • Complying with all applicable laws and regulations in Nepal
  • Respecting the rights of other users
  • Using the Service only for lawful purposes
  • Not interfering with or disrupting the Service

4. Property Listings

4.1 Listing Requirements

When listing a property on 3DGhar, you agree to:

  • Provide accurate and complete property information
  • Use only authentic photos and media of the property
  • Disclose any material defects or issues
  • Comply with all applicable real estate laws and regulations in Nepal
  • Have the legal right to list the property
  • Respond promptly to inquiries from potential buyers/renters

4.2 Listing Moderation

All property listings are subject to review and moderation. We reserve the right to reject, remove, or modify any listing that violates these Terms or our content policies. We may also require verification documents (KYC) for certain listings.

4.3 Listing Fees

Some listing features may require payment. All fees are clearly disclosed before you commit to a listing. Fees are non-refundable unless otherwise stated or required by law.

If you add a link to a video or virtual tour that is hosted on a third-party service (for example YouTube, Vimeo, or TikTok), the video continues to be provided and played by that service. 3DGhar does not host, store, or claim ownership of that content. You are solely responsible for the links you submit.

By submitting such a link, you represent and warrant that you have all necessary rights and permissions to display or promote that content in connection with your listing—including rights from the video creator, property owner, and any platform whose terms apply—and that your use does not infringe any third party's intellectual property, privacy, or other rights.

Each third-party platform has its own terms, embed rules, and restrictions; you agree to comply with them. We may remove or disable a listing or link if we reasonably believe it violates these Terms, applicable law, or a valid complaint from a rights holder.

If you believe a listing infringes your rights, contact us with sufficient detail (including the listing URL and basis of your claim) so we can review and respond in line with our policies and applicable law.

4.5 Platform role and listing accuracy

3DGhar does not independently guarantee ownership, legality, pricing, or accuracy of every listing. Listings and media are supplied by users and third parties. You rely on listing information at your own risk and should conduct your own due diligence, inspections, and legal checks before any transaction.

5. Payments and Fees

5.1 Payment Methods

We accept payments through various methods including Esewa, Khalti, ConnectIPS, and other payment gateways. All payments are processed securely through third-party payment processors.

5.2 Fees

Fees may apply for:

  • Featured property listings
  • Premium account features
  • Photography services
  • Virtual tour creation
  • Other premium services

5.3 Refunds

Refund policies vary by service. Generally, fees for completed services are non-refundable. Refund requests will be evaluated on a case-by-case basis in accordance with our Refund Policy and applicable laws. Payment processing details are in our Payment Terms; visit and booking payments may also be governed by our Token & booking terms.

6. Intellectual Property

6.1 Our Content

The Service and its original content, features, and functionality are owned by 3DGhar and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You confirm that you own or have all necessary rights and permissions to upload or post your content (including photos, floor plans, drone footage, 3D tours, listing descriptions, and documents), and that your content does not infringe third-party rights.

By posting content on the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Use, reproduce, modify, display, compress, optimize, transcode, watermark, or resize your content for hosting and delivery
  • Distribute and promote your content through the Service and optional marketing channels
  • Use your content for marketing and promotional purposes relating to 3DGhar and your listings

You retain ownership of your content and can remove it at any time by deleting your listings or account, subject to reasonable backup and retention periods.

7. Prohibited Activities

You agree not to:

  • Post false, misleading, or fraudulent information
  • List properties you do not have the right to list
  • Spam, harass, or abuse other users
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access to the Service
  • Use automated systems to access the Service without permission
  • Interfere with or disrupt the Service
  • Collect user information without consent
  • Engage in any fraudulent or deceptive practices

8. Limitation of Liability

To the maximum extent permitted by law:

  • 3DGhar is a platform that connects buyers, sellers, agents, and other parties. We do not own, sell, or guarantee any properties listed on the Service.
  • We are not responsible for the accuracy, completeness, or legality of property listings or user content.
  • We are not a party to any transaction between users and are not responsible for disputes between users.
  • We do not guarantee the availability, accuracy, or quality of the Service.
  • Our liability is limited to the amount you paid us in the 12 months preceding the claim, or NPR 10,000, whichever is greater.
  • We are not liable for any indirect, incidental, special, or consequential damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless 3DGhar, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, violation of these Terms, or infringement of any rights of another.

10. Dispute Resolution

10.1 Informal Resolution

Before filing a formal claim, you agree to contact us at support@3dghar.comto attempt to resolve the dispute informally.

10.2 Arbitration

If informal resolution is unsuccessful, disputes will be resolved through binding arbitration in accordance with the Arbitration Act of Nepal, conducted in Kathmandu, Nepal.

10.3 Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class action.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
